1. Purpose and acceptance

These terms and conditions (hereinafter "the Terms") govern access to and use of the AcheteurFuté platform (hereinafter "the Service"), operated by AcheteurFuté inc. By creating an account or using the Service, you declare that you have read, understood and unconditionally accepted these Terms as well as our Privacy Policy available at /confidentialite. If you do not accept these terms, you must immediately stop using the Service. These Terms constitute a legally binding contract between you (hereinafter "the User") and AcheteurFuté inc.

2. Description of the service

AcheteurFuté is a SaaS (Software as a Service) AI-powered real estate coaching platform, designed specifically for the Quebec market. The Service includes: - An AI-powered conversational coach (Anthropic Claude) specialized in Quebec real estate purchasing - Financial calculators (borrowing capacity, CMHC premium, welcome tax, mortgage payment, FHSA/HBP optimization, total cost of ownership) - Property import and analysis (property listings, comparisons, scores) - Neighbourhood analysis (services, transit, schools, demographic profile) - Pre-purchase inspection report analysis - A personalized assessment of your purchasing project - A post-purchase homeowner mode The Service is available in French and English. The French version prevails in case of discrepancy.

3. Registration and account

3.1 Account creation To use the Service, you must create an account by providing a valid email address. Authentication is managed via Supabase Auth (magic link or password). 3.2 Accuracy of information You agree to provide accurate, current and complete information when registering and configuring your buyer profile. AcheteurFuté cannot be held responsible for consequences resulting from inaccurate or incomplete information. 3.3 Account security You are solely responsible for the confidentiality of your login credentials. You agree to: - Not share your credentials with third parties - Notify us immediately of any unauthorized use of your account at support@acheteurfute.ca - Not create multiple accounts for the same person Any activity performed on your account is deemed to have been performed by you.

4. Plans and pricing

AcheteurFuté offers three subscription plans: - Free Plan: $0 — limited access to basic features - Exploration Plan: $15 CAD/month — unlimited AI coach, all calculators, advanced simulations - Pro Plan: $25 CAD/month — all Exploration features + unlimited properties + purchase offer coach Payments are processed securely by Stripe. AcheteurFuté does not store any credit card information. Billing: - Subscriptions are billed monthly, on the anniversary date of the subscription - Amounts are in Canadian dollars (CAD) and do not include applicable taxes - No refunds are offered for partially used periods Price changes: AcheteurFuté reserves the right to modify its prices. Any price change will be communicated by email at least 30 days before taking effect. The new price will apply to the next billing cycle following the expiry of the notice period.

5. Free plan — limits and restrictions

The free plan allows you to discover the Service with the following limitations: - Maximum of 3 AI coach messages per day - Access to 2 basic calculators only (borrowing capacity and down payment) - Maximum of 2 saved properties - Maximum of 1 property import per month - No access to the purchase offer coach - No access to advanced neighbourhood analyses - No access to inspection report analysis AcheteurFuté reserves the right to modify free plan limits at any time without notice. The free plan is offered with no guarantee of long-term availability.

6. User obligations

By using the Service, you agree to: 6.1 Legal use - Use the Service in accordance with applicable Quebec and Canadian laws - Not use the Service for fraudulent, illegal or harmful purposes - Not attempt to circumvent the limits of your subscription plan 6.2 No resale - Not resell, redistribute or commercialize access to the Service or its content - Not create a competing service based on AcheteurFuté's data or features - Not use the Service for the benefit of third parties on a commercial basis 6.3 No technical abuse - Not attempt to access other users' systems or data - Not use automated scripts, bots or scraping tools - Not deliberately overload the Service infrastructure - Not attempt to bypass security or authentication measures - Not exploit the Service API beyond normal intended use

7. Intellectual property

7.1 AcheteurFuté's property The Service, including its source code, design, calculation algorithms, AI prompt models, brand, logo and all editorial content, are the exclusive property of AcheteurFuté inc. or its licensors. You may not: - Copy, modify, adapt or distribute the content of the Service - Use the AcheteurFuté brand without prior written authorization - Attempt to decompile, disassemble or reverse engineer the Service - Systematically extract data from the Service 7.2 User data ownership You retain full ownership of your personal data, buyer profile, notes and saved analyses. AcheteurFuté claims no ownership rights over the content you enter into the Service. You grant AcheteurFuté a limited, non-exclusive and revocable license to process your data solely for the purpose of providing the Service.

8. AI-generated content

The Service uses artificial intelligence (Anthropic Claude) to generate analyses, scores, recommendations and conversational responses. IMPORTANT — PLEASE READ CAREFULLY: The analyses, scores and recommendations generated by AI are provided for informational and educational purposes only. They do NOT replace, UNDER ANY CIRCUMSTANCES: - The advice of a real estate broker certified by the OACIQ - The advice of a financial advisor licensed by the AMF - The services of a notary for the legal aspects of the transaction - The expertise of a certified building inspector - The advice of an accountant or tax specialist for tax matters AI can make mistakes, produce inaccurate or outdated information. You are solely responsible for verifying the information provided with qualified professionals before making any real estate purchase decision.

9. Personal data and privacy

The collection, use, retention and protection of your personal data are governed by our Privacy Policy, available at /confidentialite. By using the Service, you consent to the collection and processing of your data as described in said policy, in accordance with Quebec's Act 25 (An Act to modernize legislative provisions as regards the protection of personal information). 10. Liability for data loss

AcheteurFuté makes its best efforts to protect and back up user data. However, AcheteurFuté cannot be held liable for data loss resulting from: - Technical failure of the hosting infrastructure (Supabase, Vercel) - Hacking or cyberattack despite security measures in place - Human error on the part of the user (accidental deletion, sharing of credentials) - Force majeure (natural disaster, widespread Internet outage) The user is responsible for independently backing up important data. We strongly recommend regularly exporting your assessments and analyses as PDF from the platform.

11. Exclusions of liability

11.1 Accuracy of calculations AcheteurFuté's financial calculators (CMHC premium, welcome tax, borrowing capacity, mortgage payment, FHSA/HBP) are based on official schedules in effect at the time of development. AcheteurFuté does not guarantee the absolute accuracy of results. Schedules may be modified by competent authorities at any time and a delay may exist before the Service is updated. 11.2 AI analyses All analyses, neighbourhood scores, property evaluations and recommendations are generated by artificial intelligence. They may contain errors, approximations or outdated information. This content does not constitute professional advice and should not be used as the sole basis for decisions. 11.3 Service availability AcheteurFuté targets 99.9 % availability but does not guarantee it. The Service may be temporarily unavailable due to: - Planned maintenance (notified in advance when possible) - Service updates - Unforeseen technical incidents 11.4 Third-party providers The Service relies on essential third-party providers: - Anthropic (Claude artificial intelligence) - Supabase (database and authentication) - Stripe (payment processing) - Vercel (hosting) AcheteurFuté is not responsible for outages, interruptions or malfunctions of these third-party services. 11.5 Real estate market data Market data, price estimates and trends presented by the Service are AI-generated estimates. They are NOT data certified by QPAREB (Quebec Professional Association of Real Estate Brokers) or Centris. For certified market data, consult a real estate broker. 11.6 Financial limitation In all cases, AcheteurFuté's total liability to the User is limited to the total amount of subscription fees actually paid by the User during the twelve (12) months preceding the event giving rise to the claim. In no case shall AcheteurFuté be liable for indirect, incidental, special, consequential or punitive damages.

12. AcheteurFuté's commitments

AcheteurFuté commits to: - Security: Implementing reasonable security measures to protect your data (HTTPS/TLS encryption, RLS policies on the database, API keys stored server-side only) - Privacy: Never selling, renting or sharing your personal data for advertising or commercial purposes - Transparency: Clearly informing you of any changes to the Terms or Privacy Policy - Regular updates: Keeping calculators up to date with official schedules (CMHC, transfer duties, HBP, FHSA) within a reasonable time following their modification - Support: Responding to support requests within a reasonable time at support@acheteurfute.ca

13. Changes to terms and conditions

AcheteurFuté reserves the right to modify these Terms at any time. In the event of substantial changes, we will notify you by email at least thirty (30) days before they take effect. A summary of changes will be included in the notification. Minor changes (typographical corrections, clarifications without substantive change) may be applied without notice. Your continued use of the Service after the changes take effect constitutes your acceptance of the new terms. If you do not accept the changes, you must stop using the Service and cancel your subscription.

14. Termination

14.1 Termination by the client You can cancel your subscription at any time from your profile or via the Stripe management portal. Cancellation takes effect at the end of the current billing period. You retain access to your plan's features until that date. 14.2 Termination by AcheteurFuté AcheteurFuté reserves the right to suspend or terminate your account in case of: - Violation of these Terms - Fraud or attempted fraud - Abuse of the Service (deliberate overloading, scraping, unauthorized automated use) - Non-payment after formal notice - Illegal activity 14.3 Effects of termination - Access: You retain access to the Service until the end of your current billing period - Data: Your data is retained for ninety (90) days after termination, during which you can export it. After this period, your data is permanently deleted - Refund: No refund is issued for the current period, except in case of termination by AcheteurFuté without fault on the User's part

15. Applicable law and jurisdiction

These Terms are governed and interpreted in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute arising from these Terms or the use of the Service shall be submitted to the exclusive jurisdiction of the courts of the Province of Quebec, judicial district of Montreal. The parties agree to attempt to resolve any dispute amicably before initiating legal proceedings.
